SALES AND SERVICE: TERMS AND CONDITIONS

 

Welcome to Orient Collection Imports (Pty) Ltd ("OCI"). These Terms and Conditions govern your use of our website, purchases of products, and engagement of services from OCI. By accessing or using our website, or by purchasing products or services from us, you agree to be bound by these Terms and Conditions.

 

1. Product Orders and Acceptance:

  • All product orders are subject to acceptance by OCI. We reserve the right to refuse or cancel any order for any reason, including product unavailability or errors in pricing or description.

 

2. Pricing, Payment, and Ownership:

  • All prices for products are displayed on our website, are inclusive of VAT.
  • Payment is due and payable at the time of order placement, to facilitate swift processing and fulfilment of your purchase. We offer secure online payment through PayFast, South Africa's leading secure payment gateway.
  • For our existing account customers, payment terms are clearly outlined on your tax invoice, reflecting the terms agreed. Please note the terms applicable as specified on your account agreement.
  • In the event of late payment/s, additional charges such as interest or penalties may apply, or your account may be temporarily suspended until all outstanding amounts are settled in full. Detailed information regarding the consequences of late payment can be found on your invoice, and you are welcome to contact OCI for further details.
  • Ownership of goods remains vested with Orient Collection Imports (Pty) Ltd until full payment has been received.

3. Delivery and Shipping:

  • Products will be shipped to the address provided at the time of order placement. Shipping costs and estimated delivery times will be calculated during checkout. Risk of loss or damage to products passes to the customer upon dispatch of the goods.

4. Returns and Refunds:

  • Our returns policy allows for returns of products within 7 days of receipt. To be eligible for a return, items must be unused and in their original packaging, ensuring that they are in a resalable condition, and delivered at OCI premises within the return period.

  • Please note that certain items may be non-returnable. Refer to our Returns Policy for exceptions.

 

5. Warranties and Disclaimers:

  • OCI warrants its products against defects in materials and workmanship under normal use for a period as specified on the respective product's warranty page. To ascertain the duration and terms of warranty applicable to a specific product, purchaser must refer to the warranty page associated with that product.

  • Warranty coverage is subject to the exclusive inspection and evaluation by OCI to determine the nature and extent of any defects. For warranty claims or any inquiries, please contact OCI through the correct channels as is specified on the associated warranty page.
  • OCI refutes and/or denies any liability for indirect, incidental, special, or consequential damages arising from product purchases or services provided.

 

6. Limitation of Liability:

  • Under no circumstances shall OCI, its affiliates, directors, officers, employees, agents and/or contractors be liable for any indirect, incidental, special, or consequential damages arising from the use of any of the product/s purchased or services provided, including but not limited to any loss of profits, loss of data, or business interruption, whether in contract, warranty, or damages, even if advised of the possibility of such damages.

 

7. General Policy Statement:

  • OCI is committed to providing exceptional products and services to our customers across various sales channels, including but not limited to e-commerce platforms and existing account-based relationships.
  • We strive to maintain the highest standards of integrity, professionalism, and customer satisfaction in all our interactions.
  • For our account-based customers, tailored pricing, payment terms, and service agreements may apply based on individual contracts or arrangements. Detailed information regarding these arrangements can be found on your respective account agreement.
  • OCI reserves the right to modify, amend or terminate any sales or service agreements with customers at its sole discretion, in accordance with proper notice provided as per contractual obligations or per any legal requirements.

 

8. Governing Law and Jurisdiction:

  • These Terms and Conditions are governed by and shall be interpreted in accordance with the laws of the Republic of South Africa. Any disputes arising from or related to these terms shall be subject to the exclusive jurisdiction of the courts of South Africa.

 

9. Amendments and Updates:

  • OCI reserves the right to amend or update these Terms and Conditions at any time without prior notice. Any changes will be effective immediately upon posting on our website. Customers are encouraged to review the Terms and Conditions periodically for updates.
